This Privacy Policy describes how EvenUp, Inc.(“ we”, “ us”, or “ our”) handles personal information that we collect through our websites that link to this Privacy Policy, through our customers and partners who share information with us, through our marketing initiatives, when you apply for a job with us, and in connection with other interactions with you (collectively, the “ Service” or “ Services”).

Except as expressly described in a product-specific section of this Privacy Policy, this Privacy Policy does not apply to our handling of personal information that we process as a service provider or processor on behalf of our business customers. Our processing of that personal information is governed by the agreements we have with our business customers.

How We Use Your Personal Information

Additionally, as an AI business, we may use personal information to develop, improve, train, and provide our proprietary AI technologies and services for all of our customers. Where we leverage the services of third-party AI providers, we do not permit them to use your personal information to develop, improve, train, or provide their AI technologies for the benefit of their other customers.

EvenUp Add-In for Word

The EvenUp Add-In for Word, submitted to Microsoft AppSource / Microsoft Marketplace under the app name “EvenUp,” is an AI-enabled sidebar within Microsoft Word that helps authorized users draft, revise, edit, and ask questions about Word documents and, when connected by the user to an EvenUp case or matter, related case or matter files.

This section describes how EvenUp processes information in connection with the EvenUp Add-In for Word. Where EvenUp processes personal information, document content, case files, or other customer data on behalf of a business customer, such processing is governed by the applicable agreement between EvenUp and that customer.

When you use the EvenUp Add-In for Word, EvenUp may process account and authentication information; the full active Word document and related document information, including text, comments, tracked changes, user selections, edits, and other information available to the add-in; prompts and chat messages; AI-generated outputs and proposed edits; user actions and interaction data, such as accept/reject decisions, feature usage, timestamps, logs, and other add-in activity; and, where the add-in is connected to an EvenUp case or matter, case and matter information available through the EvenUp platform, such as medical records, medical bills, plaintiff information, and other case materials. EvenUp may also process technical, diagnostic, security, and usage information related to the add-in.

EvenUp uses this information to provide, operate, secure, support, monitor, and improve the add-in and related EvenUp services; authenticate users and confirm user and firm-level access rights; generate AI-assisted answers, summaries, drafts, edits, and recommendations; reference connected case or matter files; present proposed edits for user review; insert accepted edits into Word documents, including as native Microsoft Word Track Changes when Track Changes is enabled; maintain chat history and add-in context; audit use of the add-in; and protect against unauthorized, harmful, or unlawful activity.

The add-in may store prompts, chat history, AI-generated outputs, edit accept/reject actions, usage logs, audit logs, and technical or diagnostic information for the purposes described above.

How We Disclose Your Personal Information

1. Affiliates.

We may disclose your personal information to our subsidiaries and affiliates for purposes consistent with this Privacy Policy.

2. Service providers.

We may disclose your personal information to third-party companies and individuals that provide services on our behalf or help us operate our Services (such as lawyers, bankers, auditors, insurers, customer support, hosting, analytics, email delivery, marketing, and database management).

We may disclose your personal information to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

Your Privacy Rights and Choices

1. Opt out of marketing communications.

You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions contained in the marketing communication we send you. You may continue to receive service-related and other non-marketing emails.

Prior to responding to your requests, we may verify your identity by matching any requested identifying information you provide against the information we have about you. Depending on your jurisdiction, you may designate an authorized agent to make a request on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination.

3. Limits on your privacy rights and choices.

In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. Additionally, where we are processing your personal information as a service provider on behalf of a business customer and you have questions about our privacy practices or would like to exercise any rights with respect to your personal information, please contact the corresponding customer who is the controller of your personal information. Note that these tools are not associated with us and we cannot guarantee that they work as their providers advertise them. SMS/Text Messaging

We respect your privacy regarding your mobile information. We may use mobile phone numbers and related SMS information to enable SMS features, for internal testing, to deliver service-related messages (such as notifications), to provide updates on job applications and for marketing purposes.

We do not sell or share your mobile information (including your phone number) with third parties or affiliates for marketing or promotional purposes. Furthermore, your text messaging originator opt-in data and consent (including your phone number and the fact that you agreed to receive texts) will not be shared with any third parties, except as necessary with service providers to deliver the messages on our behalf.

If you receive an SMS message from us and no longer wish to receive SMS communications, you may opt out at any time by replying STOP to the message or by contacting us using the details below.

Other Sites, Mobile Applications and Services

Our website may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and disclosure of your personal information. Security

We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe and we cannot guarantee the security of your personal information.

Retention of Personal Information

Where required under applicable laws, we retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, in accordance with our retention policies, and in accordance with applicable laws and regulatory obligations.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.

Job Applicants

When you apply for one of our open positions, we collect the information that you provide in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or that you may provide during the interview process. This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information. We also collect personal information from other sources where relevant for your application, such as employment research firms, recruiters, identity verification services, and information that you make publicly available on websites or social media platforms (for example, LinkedIn).

Throughout the recruitment process, we may supplement your personal information in connection with the assessment of your application. For example, we may record the views of those considering your application about your suitability for the role for which you have applied and retain interview notes. If you accept an offer from us, your personal information will be incorporated into and used as part of your employee record.

We use applicants’ information to facilitate our recruitment activities, process employment applications and personalize candidate communication, including evaluating candidates and monitoring recruitment statistics. We also use successful applicants’ information to administer the employment relationship. We may also use and disclose applicants’ information to improve our Services and for the compliance and protection purposes described above.

Children

Our website is not intended for use by children under 18 years of age. If we learn that we have collected personal information through the website from a child under 18 without the consent of the child’s parent or guardian as required by law, we will delete it.

As described further in our Privacy Policy, we may disclose all categories of personal information to our service providers and professional advisors for the purposes described in the Privacy Policy. We also may disclose personal information to authorities and others for legal and compliance purposes, and business transferees in the context of an acquisition or the sale of our business or another corporate transaction.

EvenUp CRM Integration (Browser Extension)

The EvenUp CRM Integration, published on the Chrome Web Store under the app name “EvenUp CRM Integration,” is a browser extension that lets an authorized EvenUp user sync cases and documents from their firm’s case-management system (CRM) into EvenUp and view sync status. The extension runs only on supported CRM pages to provide CRM-to-EvenUp sync and status functionality, including through the extension interface and/or sync controls displayed on the CRM page.

This section describes how EvenUp processes information in connection with the EvenUp CRM Integration. Where EvenUp processes personal information, case files, or other customer data on behalf of a business customer, such processing is governed by the applicable agreement between EvenUp and that customer.

When you use the EvenUp CRM Integration, EvenUp may process account and authentication information, including your EvenUp user identifier, email, name, firm, role, and a scoped, time-limited access token; case and matter details; personal information contained in case records, including client/plaintiff identifiers, contact details, and related case information; documents, including their names and contents; and technical, diagnostic, security, and usage information related to the extension and sync functionality. For cases already synced to EvenUp, new unsynced documents may be uploaded to EvenUp when an authorized user visits the relevant document page, according to the firm’s integration settings.

EvenUp uses this information to provide, operate, secure, support, maintain, and improve the extension, the CRM sync functionality, and the EvenUp services; to authenticate users and confirm user- and firm-level access rights; to create and update the corresponding case in EvenUp and populate it with the synced case, client, and document information; to monitor sync status and troubleshoot sync issues; and to protect against unauthorized, harmful, or unlawful activity. EvenUp does not sell this information, transfer it to third parties for their own independent purposes, use it for any unrelated purpose, or use it to determine creditworthiness or for lending. The extension does not collect general web browsing history or activity outside supported CRM pages, does not capture CRM credentials, and does not include third-party analytics or tracking.
